Total Return Terms of Use

Effective October 16, 2026

These terms apply to your use of the Total Return app for iPhone and iPad ("the app"), published by Nagotek LLC ("we", "us", "our"). They add to Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), which also applies. By using the app, you agree to these terms and to the Total Return Privacy Policy. If you do not agree, do not use the app.

Not financial advice

The app is a tracking tool. Its figures, including total return and CAGR, are calculations based on the information you enter and on prices you enter or fetch. They are not financial, investment, tax or legal advice. Check important figures against your official account statements before relying on them.

Your data

You are responsible for the accuracy of what you enter and for keeping backups. Your data is stored on your device. We do not have a copy of it and cannot recover it if it is lost.

Third-party quote data

Quote updates use your own API key from Tiingo, an independent service not affiliated with us. Your use of Tiingo, and of the data the app fetches with your key, is governed by Tiingo's terms, including the limits of its free and paid plans and any limits on storing or sharing its data. Prices may be delayed, incomplete or unavailable, and we do not guarantee their accuracy, timeliness or availability. Without a key, you can still enter prices yourself.

Free use and subscriptions

The app is free for low-volume use. Higher levels of use require a subscription purchased through the App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel them in your Apple account settings. Payment, renewals and refunds are handled by Apple under its terms.

Acceptable use

Do not reverse engineer, resell or misuse the app, or use it in violation of any law or of Tiingo's terms.

Links to other websites

The app links to websites and services that we do not own or control, such as Tiingo and Apple. We are not responsible for their content, privacy policies or practices, and we encourage you to read their terms and privacy policies before using them.

Disclaimer

To the extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will work without interruption or errors, that defects will be corrected, that it is free of harmful components, or that its results will meet your needs.

Limitation of liability

To the extent permitted by law, Nagotek LLC and its members, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, or for investment decisions or losses, arising from your use of, or inability to use, the app or any data shown in it.

Indemnification

You agree to defend, indemnify and hold harmless Nagotek LLC and its members, employees and agents from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising from your misuse of the app or your breach of these terms.

Where these limits may not apply

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the limits above may not apply to you. Nothing in these terms limits rights you have under laws that cannot be waived by contract.

Changes

We may update these terms. The current version, with its effective date, is always available in the app and at https://nagotek.com/total-return-terms.html. When you install a new version of the app, it asks you to agree to the terms again before you continue using it.

Governing law

These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules.

General

If any part of these terms is found invalid or unenforceable, the rest of the terms stays in effect. If we do not enforce any part of these terms, that is not a waiver of it. These terms, together with the Total Return Privacy Policy and Apple's Licensed Application End User License Agreement, are the entire agreement between you and us about the app, and replace any earlier terms.
